Who Qualifies for SCRA Lease Termination?
You can use the SCRA to terminate your lease if you are:
- An active duty servicemember who receives Permanent Change of Station (PCS) orders
- A servicemember receiving deployment orders for 90 days or more
- A servicemember who signed the lease before entering active duty
- A servicemember who signed the lease while on active duty and then received PCS/deployment orders
This applies to all branches: Army, Navy, Air Force, Marines, Coast Guard, Space Force, and activated National Guard/Reserve members.
What Your Military Lease Termination Letter Must Include
A valid SCRA termination letter requires specific elements:
- Written notice delivered to the landlord (not just verbal)
- A copy of your military orders — PCS orders, deployment orders, or a letter from your commanding officer
- Reference to 50 U.S.C. § 3955 — Explicitly cite the SCRA statute

When Does the Termination Take Effect?
The SCRA has specific timing rules:
- For month-to-month leases: Termination is effective 30 days after the next rent payment date following delivery of the notice
- For fixed-term leases: Same rule — 30 days after the next rent due date following notice delivery
Example: You deliver your SCRA letter on June 15. Your rent is due on the 1st. The next rent payment after delivery is July 1. Your lease terminates 30 days later — July 31.
What Landlords Cannot Do
Under the SCRA, your landlord is prohibited from:
- Charging an early termination fee or penalty
- Withholding your security deposit as a penalty for early termination
- Requiring you to pay rent beyond the effective termination date
- Pursuing you in court for breach of lease
- Placing negative information on your rental history for exercising SCRA rights

Send your military lease termination letter via Certified Mail with Return Receipt Requested. While hand delivery is also valid, certified mail creates an undeniable paper trail showing exactly when the landlord received your notice. Keep copies of everything — the letter, your orders, the mailing receipt, and the return receipt.
